Welcome to the Sonshine Blooms website. These Terms & Conditions ("Terms") govern your access to and use of the Sonshine Blooms website and your purchase of products or services through the website.

By accessing, browsing, or using this website, or by placing an order through the website, you agree to these Terms. If you do not agree with these Terms, please do not use the website or place an order.

Sonshine Blooms is owned and operated by Mandi-Kasula Clark, a sole proprietor.

Sonshine Blooms provides floral products and floral design services, including fresh flower arrangements, bouquets, custom floral orders, and event-related floral services.

2. ELIGIBILITY TO USE THE WEBSITE

You must be at least 18 years old to place an order through the Sonshine Blooms website.

By placing an order, you represent that:

You are at least 18 years old;
You have the legal capacity to enter into a transaction;
The information you provide is accurate and complete; and
You are authorized to use the payment method provided.

The website may be browsed by individuals under 18, but purchases may only be made by adults.

3. WEBSITE USE

You agree to use the Sonshine Blooms website only for lawful purposes.

You may not use the website to:

Product descriptions, photographs, colors, sizes, and other information are provided to help customers understand what they are purchasing.

Because flowers are natural products, actual flowers may vary from photographs or examples.

Differences in:

Color;
Size;
Shape;
Bloom stage;
Flower variety;
Greenery; and
Overall appearance

may occur naturally and do not necessarily indicate that an order was incorrect.

5. FLORAL SUBSTITUTIONS

Flower availability can change due to season, weather, growing conditions, transportation, supplier availability, market conditions, and other circumstances outside Sonshine Blooms' control.

Sonshine Blooms reserves the right to make reasonable substitutions when necessary.

When a substitution is required, Sonshine Blooms will make reasonable efforts to maintain the original order's:

Overall style;
Color palette;
Quality;
Size and scale; and
Overall value.

A reasonable substitution does not constitute a breach of these Terms or automatically entitle the customer to a refund.

6. CUSTOM ORDERS & EVENT SERVICES

Some products or services may require custom design, consultation, advance ordering, or a separate agreement.

Custom weddings, bridal services, events, installations, large floral orders, and other contracted floral services may be subject to a separate Sonshine Blooms Floral Services Agreement.

When a separate agreement is signed, that agreement governs the applicable custom service.

In the event of a conflict between these Website Terms & Conditions and a signed Floral Services Agreement, the signed Floral Services Agreement will control for the custom services covered by that agreement, to the extent permitted by applicable law.

7. PRODUCT AVAILABILITY

All products are subject to availability.

Sonshine Blooms does not guarantee that a particular product, flower, color, variety, or arrangement will always be available.

We may discontinue, modify, or replace products at any time.

If an ordered product becomes unavailable before the order can be fulfilled, Sonshine Blooms may contact the customer regarding a reasonable alternative or may cancel and refund the affected portion of the order.

8. ORDERS

Placing an order through the website constitutes an offer to purchase the selected products.

An order confirmation does not necessarily mean that Sonshine Blooms has accepted the order.

Sonshine Blooms reserves the right to accept, decline, limit, or cancel an order for reasonable business reasons, including:

Product availability;
Inability to fulfill the order;
Incorrect product or pricing information;
Suspected fraud;
Payment problems;
Delivery limitations;
Website or technical errors; or
Other circumstances that make fulfillment impractical or inappropriate.

If Sonshine Blooms cancels an order after payment has been received, the applicable payment will generally be refunded.

9. PRICING

Prices displayed on the website are subject to change without notice.

Sonshine Blooms makes reasonable efforts to ensure that pricing information is accurate. However, an accidental pricing or listing error may occur.

If an item is listed at an incorrect price due to a typographical, technical, or other error, Sonshine Blooms reserves the right to:

Correct the price;
Contact the customer regarding the correct price; or
Cancel the affected order and issue an applicable refund.

The price presented at checkout is the price applicable to an accepted website order, subject to correction of obvious errors.

10. PAYMENT

Website purchases are processed through the payment methods made available at checkout, which may include Squarespace Payments and its applicable payment-processing partners.

By submitting payment information, you represent that you are authorized to use the payment method.

Orders may not be processed until payment has been successfully authorized.

Sonshine Blooms does not intentionally store complete payment card information on its own systems.

Payment processing may be subject to the terms and privacy practices of the applicable payment processor.

11. DELIVERY

When delivery is available, customers are responsible for providing accurate delivery information.

Customers should provide:

Recipient's full name;
Complete delivery address;
Recipient telephone number when requested;
Apartment, unit, suite, or other identifying information;
Delivery instructions; and
Any information reasonably necessary to complete the delivery.

Sonshine Blooms is not responsible for delivery problems caused by inaccurate, incomplete, or incorrect information supplied by the customer.

Additional delivery charges may apply when a delivery must be attempted again because of inaccurate information, an inaccessible location, or other circumstances caused by the customer or recipient.

12. DELIVERY DELAYS

Sonshine Blooms will make reasonable efforts to complete deliveries within the applicable delivery window.

However, delivery times may be affected by:

Weather;
Traffic;
Road closures;
Vehicle problems;
Unsafe driving conditions;
Recipient availability;
Venue or building restrictions;
Incorrect delivery information;
High-volume holidays;
Other vendors or delivery providers; or
Other circumstances outside Sonshine Blooms' reasonable control.

A delivery window is not necessarily a guaranteed delivery time unless Sonshine Blooms expressly agrees otherwise in writing.

13. WEATHER & NATURAL CONDITIONS

Fresh flowers are living, perishable products and are affected by environmental conditions.

Sonshine Blooms is not responsible for deterioration or damage resulting from conditions outside its reasonable control, including:

Extreme heat;
Extreme cold;
Direct sunlight;
Wind;
Humidity;
Improper storage;
Improper handling; or
Delays after delivery.

Customers are responsible for following any care instructions provided with their flowers.

14. REFUNDS & CANCELLATIONS

Website orders are subject to the Sonshine Blooms Website Refund & Return Policy, which is incorporated into these Terms by reference.

Because fresh flowers are perishable products, sales of fresh flowers and floral arrangements are generally final.

Customers should review the Refund & Return Policy before placing an order.

Custom event services and other contracted floral services are subject to the applicable Floral Services Agreement.

15. CUSTOMER INFORMATION

Customers are responsible for providing accurate, current, and complete information when placing an order.

Sonshine Blooms is not responsible for problems caused by incorrect customer information.

If you discover an error in your order information, contact Sonshine Blooms as soon as possible.

We will make a reasonable effort to correct errors when possible, but corrections may not be possible once an order has entered preparation or delivery.

16. WEBSITE CONTENT

All content appearing on the Sonshine Blooms website, including where applicable:

Business name;
Logo;
Text;
Graphics;
Website design;
Original photographs;
Product descriptions;
Original floral design concepts;
Videos;
Marketing materials; and
Other original content

is owned by or licensed to Sonshine Blooms unless otherwise stated.

This content may not be copied, reproduced, modified, distributed, sold, or commercially exploited without prior written permission.

17. PHOTOGRAPHS & FLORAL DESIGNS

Photographs displayed on the website are intended to provide examples of Sonshine Blooms' work.

Because floral arrangements are individually designed and flowers are natural products, the final product may vary from website photographs.

Website photographs do not guarantee that an order will contain the exact flowers, colors, quantities, shapes, or arrangement shown.

Sonshine Blooms retains the right to display photographs of its own floral designs for business and portfolio purposes, subject to applicable permissions and its Privacy Policy.

18. THIRD-PARTY WEBSITES & SOCIAL MEDIA

The Sonshine Blooms website may contain links to third-party websites, including social media platforms such as Instagram, Facebook, Pinterest, or other services.

These links are provided for convenience.

Sonshine Blooms does not control or endorse the content, privacy practices, security, availability, or policies of third-party websites.

Your use of third-party websites is subject to the terms and policies of those websites.

Sonshine Blooms is not responsible for losses or problems arising from your use of third-party websites.

19. WEBSITE AVAILABILITY

Sonshine Blooms makes reasonable efforts to keep the website available and functioning properly.

22. FORCE MAJEURE

Sonshine Blooms will not be responsible for delays or failure to perform caused by circumstances beyond its reasonable control.

Such circumstances may include:

Severe weather;
Natural disasters;
Fire;
Flood;
Government restrictions;
Road closures;
Transportation disruptions;
Supplier interruptions;
Widespread shortages;
Utility or technology failures;
Acts of God; or
Other extraordinary circumstances beyond reasonable control.

When reasonably possible, Sonshine Blooms will communicate with affected customers and determine an appropriate solution.

23. FRAUD & SUSPICIOUS TRANSACTIONS

Sonshine Blooms reserves the right to refuse or cancel transactions that appear fraudulent, unauthorized, abusive, or otherwise suspicious.

Additional information may be requested to verify an order or payment.

If an order is canceled for a legitimate fraud or security concern, any refund will be handled in accordance with applicable payment-provider procedures and law.

24. ELECTRONIC COMMUNICATIONS

When you contact Sonshine Blooms electronically or place an order through the website, you consent to receive electronic communications related to your transaction or inquiry.

These communications may include:

Order confirmations;
Payment confirmations;
Delivery communications;
Customer-service responses;
Order updates; and
Other communications necessary to complete a transaction.

Transactional communications are not the same as promotional marketing communications.

25. NO MARKETING SUBSCRIPTION

Sonshine Blooms does not currently operate a website newsletter or promotional text-message subscription.

If promotional communications are offered in the future, applicable consent and opt-out requirements will be followed.

26. CHANGES TO THE WEBSITE

Sonshine Blooms reserves the right to modify, update, suspend, or discontinue any portion of the website or its products and services at any time.

We may change:

Products;
Services;
Pricing;
Availability;
Website features;
Content;
Ordering procedures; and
Other website functionality.

Changes will not retroactively alter the terms of an already accepted order unless required by law or agreed upon by the customer.

27. CHANGES TO THESE TERMS

Sonshine Blooms may update these Terms from time to time.

When changes are made, the "Effective Date" at the top of this page will be updated.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.

For significant changes affecting existing customers, Sonshine Blooms may provide additional notice when appropriate.

28. DISPUTE RESOLUTION

If a dispute arises concerning a website purchase or use of the website, the parties agree to first make a good-faith effort to resolve the matter through direct communication.

If the matter cannot be resolved through direct communication, the parties may mutually agree to mediation before pursuing formal legal proceedings, where appropriate and permitted by law.

Nothing in this provision prevents either party from seeking emergency or other legal relief that cannot reasonably be delayed.

29. OHIO LAW

These Terms shall be governed by and interpreted in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles.

30. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

31. NO WAIVER

A failure by Sonshine Blooms to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision in the future.

32. ENTIRE AGREEMENT

These Terms, together with the Sonshine Blooms Privacy Policy, Website Refund & Return Policy, Cookie Policy, and any applicable written agreement or order confirmation, constitute the applicable terms governing use of the website and website purchases.

For custom floral events and services covered by a separately signed Floral Services Agreement, the terms of that signed agreement will control as provided in Section 6.
